These Terms of Service (ToS) define the terms and conditions under which the company GOODSPOTS makes this Website available to users.

By accessing and using this website and its content, the User accepts these terms of use without reservation, and must therefore read them carefully. If the User refuses these terms of use, they must stop browsing This Site.

Article 1 - Definitions

GOODSPOTS: refers to the French company registered with the NANTES Trade and Companies Register under number 102 963 733.

Site: refers to the website hosted under the domain name "goodspots.app".

Application: refers to the mobile application, available on iOS or Android devices, allowing access to GOODSPOTS Services.

Publisher: refers to the company GOODSPOTS, which publishes and makes available the GOODSPOTS Site and Application.

User: refers to any natural or legal person, individual or professional, visiting and accessing the Site, after acceptance of these ToS.

Services: refers to the Services offered by GOODSPOTS to the User, both via the Site and via the Application.

Subscription: refers to the open-ended subscription contract for one of the paid licenses offered on the Site, concluded between the User and GOODSPOTS.

General Terms and Conditions of Sale or GTC-S: refers to the General Terms and Conditions of Sale that apply to any customer purchasing the Services offered by GOODSPOTS.

Terms of Service or ToS: refers to these present Terms of Service that apply to any User accessing the GOODSPOTS Site.

Party(ies): refers, jointly or separately, to GOODSPOTS and the User.

Any reference to the singular includes the plural and vice versa.

Any reference to one gender includes the other gender.

Article 2 - Scope of application

These Terms of Service apply to all pages of the GOODSPOTS site (hereinafter referred to as "This Site").

However, they do not concern pages that are not the property of This Site and which are nevertheless accessible via hyperlinks (which are subject to their own terms of use).

These Terms of Service are supplemented by General Terms and Conditions of Sale.

Article 3 - Purpose of the site

This Site aims to help find parking and service spots for motorhomes around the world, share travel experiences, and publish classified ads related to the world of motorhomes.

GOODSPOTS is also available as mobile applications for iOS (Apple App Store) and Android (Google Play Store). These mobile applications are subject to the same terms of use as This Site, in addition to the general terms of their respective app stores.

The mobile applications give access to the same spots and services as This Site, with additional features optimized for mobile use.

Article 4 - Access to the Site

4.1. Conditions of access

The Site is accessible to any internet user, provided they have an internet connection.

Use of the Site is free, with no purchase obligation.

Access to the Site is not subject to the creation of a User Account.

The User may, without creating an account, add and have spots published on the map, after validation by the Site.

However, creating an account is required, in particular, to access the Site's additional features, and notably to publish classified ads.

4.2. Creation of a User account

Creating a User account requires clicking on the "Sign in" button, then "Create an account".

Creating the User account is subject to providing various data such as: email address, username, display name (optional) and the choice of a password allowing identification.

By proceeding to create this Account, the User undertakes to provide only accurate information.

The User's login and password remain entirely under their responsibility, and it is up to them to ensure the confidentiality of their information.

4.3. Use of the account

After creating the User Account, the User may access it at any time by entering their login and password.

It is specified that the addition of spots and ads is validated by the Site before their first publication and may be removed upon legitimate request, namely for any addition of spots or ads that would be unlawful, misleading, or infringing on third-party rights.

4.4. Account deletion

To delete their User Account, the User must go to their profile, in the settings section, scroll the page to the bottom and click on the "Delete my account" button.

Article 5 - Intellectual property

The entire Site, its name, architecture, databases or visual or audio content (including texts, images, videos, and any other document), as well as the trademark, logos, and other distinctive signs, and more generally the Site's graphic charter, with the exception of free content, remain the property of the Publisher, in accordance with French law.

Reproduction, transmission or representation, on any medium and by any process, in whole or in part, of the Publisher's intellectual property rights must first be the subject of a written agreement with the Publisher. In all cases, the source will be indicated.

Any unauthorized reproduction, transmission or representation, in whole or in part, of the Publisher's intellectual property rights is therefore strictly prohibited and may constitute counterfeiting.

The use of links pointing to the site is nevertheless permitted, the Publisher reserving the right to request the removal of any reference to the site, including images, logos, screenshots, mentions and links, if their use is contrary to the purpose of the site.

The User remains the owner of the intellectual property rights in the content, in particular spots and ads, that they publish on the Site.

By publishing content, the User authorizes GOODSPOTS, on a non-exclusive and free basis, to use this content worldwide and for the entire duration of its online publication, for the purposes of operating, displaying, maintaining and promoting the Site.

This authorization allows GOODSPOTS in particular to:

GOODSPOTS undertakes not to exploit the content for commercial purposes independent of its service without the User's agreement and to respect their moral rights.

The User warrants that they hold the rights to the content uploaded and that it does not infringe on the rights of third parties.

Article 6 - Moderation

Users remain entirely responsible for the content they publish on the Site.

Any content that is, in a non-exhaustive manner, off-topic, insulting, defamatory, harassing, inciting hatred, or containing personal attacks, may be reported and removed without notice or recourse.

Users may report any content, ads or spots, via the "Report a problem" link provided for this purpose, accessible on each spot and ad, allowing the Publisher to examine these reports diligently and take the necessary measures.

Article 7 - Accessibility

This Site is deemed to be accessible at all times. However, we cannot guarantee this accessibility in case of network incident, absolute necessity, force majeure or any event beyond the publisher's control. In addition, the site may be closed for maintenance or update operations. The publisher may also deny access to certain users, permanently or temporarily, in case of misbehavior.

Article 8 - Data and privacy

GOODSPOTS only collects the personal data necessary for the provision of its Services and in particular for account creation, and does its utmost to ensure the security of its Users' personal data.

The User has a right of access, modification and opposition concerning any data relating to them.

We will never share or sell the data collected on This Site to third parties, except for legal reasons at the request of judicial authorities.

This Site does not use cookies and does not collect data on the use of This Site.

Users are invited to refer to the "Privacy" page of the Site to obtain all the information relating to this point.

Article 9 - Site funding

Access to and use of This Site and the mobile applications are free for basic features.

This Site is funded in part through self-funding, donations, partnerships and paid Subscriptions.

9.1 - Paid Subscriptions

GOODSPOTS offers optional paid Subscriptions ("GoodSpots Premium") providing access to additional features.

Subscriptions are available as monthly or yearly plans and can be purchased through the mobile applications via Apple App Store or Google Play Store in-app purchases.

The terms of Subscription are detailed in the General Terms and Conditions of Sale (GTC-S).

9.2 - Donations

The User can also support This Site by making a donation (please see the Support Us page).

Article 10 - Liability

In accordance with the law, the Site's liability cannot be engaged for any damage related to the use of This Site, including, but not limited to, service interruption.

The user is solely responsible for their use of the Site, the information they enter, and the content they post.

As such, the User undertakes to provide accurate, clear, precise and up-to-date information, and declares that they use the Site in a strictly personal and lawful manner, and in accordance with its purpose.

Article 11 - Applicable law - Jurisdiction - Disputes

11.1. Applicable law

These Terms of Service are subject to French law.

Should these ToS be translated into a foreign language, only the French text shall prevail in the event of a dispute over the meaning of a term or provision hereof.

11.2. Jurisdiction and dispute resolution

Disputes that may arise between the Publisher and the User shall be subject to an attempt at amicable resolution before any legal action.

In case of dispute and failing an amicable agreement, any dispute shall be brought before the courts of GOODSPOTS' registered office, including in case of multiple defendants, this being expressly accepted by the user.

Article 12 - Modifications of the terms of use

We reserve the right to modify, update and rectify, freely and at any time, without notice, these Terms of Service, in particular with a view to compliance with legislative, regulatory and/or jurisprudential changes.

Any modification will be directly and automatically applicable to the User.
